IMPORTANT: By accessing or using GotGhosted.io, you agree to be bound by these Terms of Service. If you do not agree, do not use the platform. These terms contain important disclaimers about the nature of community-sourced data.

1. Acceptance of Terms

These Terms of Service constitute a legally binding agreement between you (“User”) and GotGhosted Inc. (“GotGhosted”) governing your access to and use of the GotGhosted platform, including gotghosted.io, the Ghost Shield Chrome Extension, the Clean Slate Verification Kit, the Ghost-Free Job Board, and all related services.

By creating an account, submitting content, or accessing any part of the Platform, you confirm that you are at least 18 years of age and have the legal capacity to enter into this agreement.

2. Description of Service

GotGhosted is a community-powered platform that collects and publishes anonymous candidate submissions about hiring experiences. The Platform calculates a proprietary GhostRate™ score for companies based on these submissions.

2.1 GhostRate™ Score

The GhostRate™ score is a composite metric calculated from community submissions across five weighted dimensions: Ghosting Frequency, Stage Severity, Process Integrity, Communication Quality, and Offer Integrity. Scores are Bayesian-smoothed and assigned confidence tiers based on submission volume.

CRITICAL DISCLAIMER: GhostRate™ scores are based entirely on community-sourced, anonymous submissions. They represent aggregated opinions and reported experiences of individual users — not verified facts. GotGhosted does not independently verify or confirm the accuracy of any individual submission.

3. User Submissions

3.1 Submission Standards

By submitting content to GotGhosted, you represent and warrant that:

→Your submission describes your own direct, personal experience with the named company's hiring process
→Your submission is truthful and accurate to the best of your knowledge
→Your submission does not contain false statements of fact presented as objective truth
→Your submission does not include personally identifiable information about individual recruiters or employees
→Your submission does not violate any confidentiality agreement or NDA you have with the named employer
→You are not submitting on behalf of a competitor or any party with a financial interest in damaging the company's reputation

3.2 Prohibited Submissions

→Submissions containing defamatory statements — false statements of fact presented as true
→Submissions that disclose confidential, proprietary, or trade secret information
→Submissions made in bad faith, including coordinated campaigns to inflate a company's GhostRate™ score
→Submissions containing personal attacks, harassment, or discriminatory content targeting individuals

3.3 License to User Content

By submitting content, you grant GotGhosted a perpetual, worldwide, royalty-free license to use, reproduce, modify, aggregate, and display your submission for the purpose of operating and improving the Platform.

4. Disclaimer of Warranties

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. GOTGHOSTED EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

GotGhosted makes no representation that any GhostRate™ score accurately reflects a company's actual hiring practices, that any submission is truthful, or that the Platform will be available uninterrupted or error-free.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOTGHOSTED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM. GOTGHOSTED'S TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID IN THE PRIOR 12 MONTHS OR $100.00.

6. Indemnification

You agree to indemnify and hold harmless GotGhosted Inc., its officers, directors, and employees from any claims, damages, or expenses (including attorneys' fees) arising from your violation of these Terms, your submissions, or your infringement of any third-party rights.

7. Intellectual Property

The GotGhosted name, GhostRate™, Ghost Shield™, Clean Slate™, and Ghost-Free™ are the exclusive property of GotGhosted Inc. The Platform's code, algorithms, and non-user-generated content are protected by copyright and intellectual property laws.

8. Privacy

Your use of the Platform is governed by GotGhosted's Privacy Policy, incorporated into these Terms by reference.

9. Governing Law

These Terms are governed by the laws of the State of Florida. Disputes shall be resolved by binding arbitration in Miami-Dade County, Florida under AAA rules, except either party may seek injunctive relief in any court of competent jurisdiction.

10. Changes to Terms

GotGhosted may modify these Terms at any time. Material changes will be communicated via email or prominent Platform notice. Continued use constitutes acceptance of revised Terms.
